1. About Bonjour Soir
Bonjour Soir is a Paris-based editorial publication and curated pre-owned marketplace. Where required by applicable law, our publishing director and host information are available on request.
2. Acceptance & eligibility
By browsing Bonjour Soir, creating an account, listing an item, placing an order or otherwise using any feature of the site, you confirm that (a) you are at least 18 years old and have full legal capacity to enter into a contract, (b) you accept these Terms and our Privacy Policy, and (c) where you act on behalf of a legal entity, you have the authority to bind that entity.
If you do not agree with any provision of these Terms, you must stop using the site.
3. Accounts & sign-in
Accounts are created through Google Sign-In via NextAuth. You are responsible for keeping your credentials secure and for all activity that occurs on your account. Notify us without delay at security@bonjoursoir.com if you suspect unauthorised access.
We may refuse, suspend or terminate any account that violates these Terms, presents a fraud or money-laundering risk, or is flagged by our payment partners.
4. Editorial content & outbound links
Editorial articles, brand profiles and curated edits are provided for information and inspiration only. Where we link to third-party merchants, the resulting transaction is concluded directly between you and that merchant under their own terms — we are not a party to it and accept no liability for delivery, conformity or after-sales service of goods purchased through outbound links.
5. The pre-owned marketplace
The Marketplace allows verified sellers to list authenticated pre-owned fashion items and allows registered buyers to purchase them through our escrow-backed checkout. Bonjour Soir acts as an intermediary platform within the meaning of the EU Digital Services Act and Article 14 of the e-Commerce Directive; it is not the seller of items listed by users, except where an item is expressly marked as “Sold by Bonjour Soir”.
6. Listings & seller obligations
By submitting a listing, the seller represents and warrants that:
- they are the lawful owner of the item and have the right to sell it;
- the item is authentic, was not obtained illegally, and is not a counterfeit, replica, or copy;
- the description, photos, condition grade, materials and measurements are accurate, complete and not misleading;
- the listing complies with all applicable laws, including consumer protection, customs, CITES and product-safety rules;
- when acting in a professional capacity, the seller will identify itself as such and comply with the applicable consumer-law obligations (information duties, right of withdrawal, legal warranty of conformity).
We may, at our sole discretion, decline, edit or remove any listing, and we may require additional documentation before allowing an item to go live.
7. Authentication & concierge handling
Items sold through the Marketplace are routed through our atelier in Paris (or a partner authentication centre) for in-person inspection and authentication before being released to the buyer. We rely on a combination of human expertise and certified partners (which may include digital fingerprinting providers such as Entrupy). While we take every reasonable measure to confirm authenticity, no authentication process is infallible; our assessment does not constitute an absolute guarantee.
If the item fails authentication, the order is cancelled and the buyer is refunded in full. The seller authorises us to return the item at the seller's cost, or to retain it pending further analysis where fraud is suspected.
8. Payments, fees & payouts
Payments are processed by Stripe and, for seller payouts, by Stripe Connect. To receive funds, sellers must complete Stripe's Know-Your-Customer (KYC) onboarding and accept the Stripe Connected Account Agreement.
The buyer's payment is captured at the time of order and held by our payment partner. The applicable commission (the “Bonjour Soir Fee”) and a buyer-protection contribution are disclosed on the listing page and on the checkout summary before payment. Sellers receive the net amount on their Stripe balance once the order has been confirmed received by the buyer or once the protection window has elapsed.
All amounts are shown in euros (EUR) and include any applicable VAT where indicated. Sellers are solely responsible for declaring and paying any taxes due on their sales in their country of residence.
9. Buyer protection & escrow
Funds are released to the seller only after (a) the item passes authentication, (b) the buyer confirms receipt, or (c) the protection window of 72 hours after delivery elapses without a complaint, whichever happens first. During this window the buyer may open a dispute through their account.
10. Shipping & receipt
Sellers ship to the Bonjour Soir hub using the prepaid label we provide, within the deadline shown in the dashboard. Title transfers to the buyer upon successful authentication and onward dispatch. Risk of loss in transit between the seller and the hub is covered by our shipping policy; risk transfers to the buyer upon delivery by the carrier.
11. Returns, withdrawal & disputes
Consumer right of withdrawal (EU). Where the seller acts in a professional capacity, the buyer benefits from the 14-day right of withdrawal provided for in Article L221-18 of the French Code de la consommation. Pre-owned items listed by an identified professional reseller are within scope; the buyer must return the item to the address indicated within 14 days of notice of withdrawal and bears the return shipping cost unless agreed otherwise.
Consumer-to-consumer sales. The right of withdrawal does not apply to sales between two private individuals. In that case, our buyer protection and dispute process described in section 9 apply.
Disputes are first handled by Bonjour Soir support. If a satisfactory resolution cannot be reached, EU consumers may use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
12. Prohibited items & conduct
The following are not permitted on Bonjour Soir:
- counterfeit, replica or unauthorised reproductions;
- stolen goods or items subject to a third-party legal claim;
- items made from protected animal species in violation of CITES (real fur, ivory, exotic skins without the required permits);
- items that infringe intellectual-property or personality rights;
- any attempt to circumvent the Marketplace by completing the transaction off-platform;
- fraudulent, abusive, defamatory, harassing or otherwise unlawful behaviour towards staff, sellers, buyers or third parties.
Violations may result in immediate removal of listings, suspension of payouts, account termination and, where appropriate, referral to the competent authorities.
13. Intellectual property
The Bonjour Soir name, logos, look-and-feel, source code, editorial content and original photography are protected by copyright and trade-mark law. Except for fair-use quotation with attribution, no part of the site may be copied, scraped, republished or used to train machine-learning models without our prior written consent.
Third-party brand names and house marques appear for editorial and identification purposes only and remain the property of their respective owners.
14. User content & licence
By posting a listing, photograph, message, review or other content on Bonjour Soir, you grant us a worldwide, royalty-free, non-exclusive, sub-licensable licence to host, store, reproduce, adapt, translate and display that content for the operation, marketing and promotion of the Marketplace. You retain ownership of your content and may remove it at any time, subject to legal retention obligations.
15. Suspension & termination
You may close your account at any time from your account settings or by writing to us. We may suspend or terminate access where you breach these Terms, where a transaction is flagged for fraud, or where we are required to do so by law or by our payment partners. Open orders remain subject to these Terms until completed or refunded.
16. Liability & disclaimers
To the maximum extent permitted by law, Bonjour Soir is not liable for indirect or consequential loss, loss of profit, loss of data or loss of opportunity. Nothing in these Terms limits any liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, for fraud, or for breach of the legal warranty of conformity (Articles L217-3 et seq. of the French Code de la consommation) or warranty against hidden defects (Article 1641 of the Civil Code) where Bonjour Soir is the seller of the goods.
The Marketplace is provided “as is”. We do not warrant uninterrupted availability or that the site will be free of bugs or security incidents, but we take all reasonable steps to keep it secure.
17. Governing law & jurisdiction
These Terms are governed by French law. Disputes are subject to the exclusive jurisdiction of the competent courts of Paris, France, subject to any mandatory consumer-protection rules giving a consumer the option to bring proceedings before the court of their place of residence.
18. Changes to these terms
We may amend these Terms to reflect changes to our services or to applicable law. Material changes will be notified by email or via an in-app banner at least 15 days before they take effect. Continued use of the site after the effective date constitutes acceptance of the updated Terms.
